Pole Terms of Use

1. About the Pole Service

Pole is a gaming space for your people.

Depending on the available version of the Pole application, the user may be able to:

• create an account and profile;
• create servers and join existing servers;
• create and use channels and rooms;
• participate in text chats;
• exchange direct messages;
• send user content, including images, emoji, and GIFs;
• join voice chats;
• use the Global Voice and Group Voice features if they are available to the user;
• create and view server events;
• use other features added as the Service develops.

The inclusion of a particular feature in Pole's description does not mean that it is necessarily available in every version of the application or to every testing participant.

2. Closed beta testing

Pole is made available to a limited group of users to test the product before its public launch.

The user understands and accepts that at this stage:

• certain features may be incomplete or operate unstably;
• the application may contain errors;
• functionality, the interface, and the operating rules of individual features may change;
• servers or individual features may become temporarily unavailable;
• test data may be changed or deleted when infrastructure is updated;
• access to closed testing may be restricted or discontinued;
• Pole may release mandatory application updates.

The closed beta version is not intended for storing critically important data or information whose loss could cause substantial harm to the user.

The provisions of this section apply only to the extent permitted by law and do not waive the Provider's obligations to give the user access to their digital records or to preserve, transfer, or delete them where required by law.

3. User account and age

Registration of an account may be required to use Pole.

The user must:

• provide accurate information during registration;
• keep account login credentials secure;
• not disclose the password to third parties;
• not use another person's account without the owner's permission;
• notify the Pole team at hello@pole.team if the user becomes aware of unauthorized access to the account.

All actions performed through the user's account before compromise is reported may be treated as the actions of that user unless the circumstances indicate otherwise.

The minimum age for independent use of the Service is 6 years. If applicable law requires the consent of a legal representative for data processing or entry into the Agreement, the user may use the Service only after obtaining such consent.

4. Profile and Pole ID

In Pole, the user may use a username, Pole ID, avatar, and other available profile elements.

The user must not use information or materials in the profile that:

• infringe the rights of third parties;
• mislead other users about the identity of the account owner;
• are used to impersonate another person, a Pole representative, or another party without proper grounds;
• contain materials prohibited by law.

Certain profile elements may be visible to other Pole users in accordance with the application's logic.

If profile elements become available to an indefinite group of persons, before such disclosure the Provider informs the user about data visibility and, where required by applicable law, obtains separate consent to the dissemination of personal data.

5. Servers, roles, and communities

Pole users may create servers, join public servers, and apply to join private servers.

The server creator receives the Owner role.

Owner, Admin, Moderator, and User roles may be used within a server, together with individual permissions and special voice features.

The user understands that owners and participants with the relevant permissions may manage the server and take moderation actions provided by Pole, including:

• changing access to individual channels and features;
• managing roles within the granted permissions;
• applying Mute;
• moving participants between voice channels and rooms;
• deleting messages where the relevant permissions are held;
• blocking a user on a particular server.

The rules and decisions of an individual user server's administration are established by its owner and the participants appointed by that owner within Pole's capabilities.

The Pole team is not required to intervene in every internal dispute between participants of a user server unless the dispute concerns Service security, a violation of this Agreement, or legal requirements.

6. Messages and user content

The user may create and send messages and other user content through Pole.

The user is responsible for content that they post or send through Pole.

Pole must not be used to post or distribute:

• materials whose distribution is prohibited by law;
• content that infringes copyrights, exclusive rights, or other rights of third parties;
• malicious files, programs, or links;
• spam or bulk unsolicited messages;
• materials intended for fraud or to mislead other users;
• threats or content intended to cause real harm to others;
• information obtained through unlawful access to another person's accounts, systems, or data.

Pole does not become the owner of user content merely because the user posts it in the Service.

For the period during which content is hosted, the user grants the Provider a non-exclusive, royalty-free right to store, reproduce, technically transform, display, and transmit user content solely to the extent objectively necessary to operate the Pole features selected by the user, and to entrust the corresponding technical operations to the Provider's processors and infrastructure contractors. This right does not transfer the exclusive right to the content to the Provider.

After the content or account is deleted, this right terminates, except where individual copies must be temporarily retained by law, in backups until their scheduled overwrite, or for dispute resolution or protection of the rights of the Provider and users.

The user confirms that they have the right to post and transmit such content through the Service.

7. Voice communication

Pole provides voice communication features, including standard voice chats and, where the relevant permissions are held, Global Voice and Group Voice.

The user independently decides when to join voice communication and when to enable their microphone.

When using voice communication, the user must respect the rights and interests of other participants.

The user is solely responsible for recording, storing, or distributing the voices and conversations of other participants if the user performs such actions using third-party tools.

The processing of data directly required for voice communication is also governed by the Pole Privacy Policy.

8. Prohibited use of the Service

The user must not:

• attempt to gain unauthorized access to other users' accounts, data, or Pole's internal systems;
• circumvent access restrictions, blocks, or permission mechanisms;
• interfere with servers, voice communication, or other Pole components;
• intentionally impose an excessive load on the infrastructure;
• distribute malicious software through Pole;
• exploit discovered vulnerabilities to gain access to data or features not intended for the user;
• use automated tools for bulk account creation, spam, or other actions that disrupt the normal operation of the Service;
• impersonate a representative of the Pole team without permission;
• use Pole in a manner that violates applicable law or the rights of others.

If the user discovers a vulnerability or serious technical error, it may be reported to hello@pole.team.

9. Access to the closed beta version

Access to the Pole closed beta version is provided for testing the Service.

Without separate permission from the Pole team, the user must not:

• sell access to closed testing;
• transfer the user's account to others to provide access to the beta version;
• distribute internal test builds of the application on behalf of Pole;
• present modified application builds as official Pole versions.

The Pole team may change the testing access procedure, limit the number of participants, or discontinue individual test builds.

10. Restriction and termination of access

The Pole team may temporarily restrict or terminate a user's access to all or part of the Service where necessary:

• to protect Pole and its users;
• to prevent abuse;
• in the event of a material or repeated breach of this Agreement;
• in the event of attempts to interfere with the operation of the Service;
• where the Service is used for unlawful activities;
• during technical work or changes to the conditions of closed testing.

Separately from restrictions imposed by the Pole team, a user may be blocked by the owner or administration of a particular server in accordance with that server's roles and permissions system.

A block on one user server does not by itself mean that the entire Pole account is blocked.

11. Rights in Pole

Rights in Pole's software code, interface, graphic elements, texts, name, logo, and other elements belong to their respective rights holders unless expressly stated otherwise.

The user receives the right to use the version of Pole available to them solely for ordinary use of the application and participation in closed beta testing.

Unless otherwise expressly permitted by a rights holder or by law, the user must not:

• distribute modified versions of the application as official Pole versions;
• remove rights-holder notices;
• use Pole's name, logo, or visual identity in a way that creates a false impression of an official partnership or representation;
• use Pole materials to create misleading copies of the Service.

This Agreement does not transfer exclusive rights in Pole or any of its individual elements to the user.

12. Third-party services

Pole may use third-party technical services and infrastructure to operate individual features.

The operation of such components may depend on the availability of the relevant third-party services.

The Pole team cannot guarantee uninterrupted operation of external infrastructure outside its direct control.

Data processing when such components are used is carried out in accordance with the Pole Privacy Policy and the applicable terms of the relevant services.

13. Personal data and privacy

The conditions for processing user data are described in the separate Pole Privacy Policy.

The Privacy Policy is an informational document and does not by itself replace the user's separate consent to personal data processing where such consent is required by applicable law.

For questions about data processing, access, correction, portability, restriction, or deletion, the user may contact hello@pole.team or use the relevant feature in the application/on the website if available.

14. Withdrawal from the Service, copies, and data deletion

The user may withdraw from the Service at any time using a method available in the account or by contacting hello@pole.team.

After receiving the withdrawal, the Provider informs the user what digital records relating to the user are held by the Provider, what options are available for obtaining a copy or transferring the data, and provides an opportunity to request deletion unless continued retention is required by law.

Until the user's decision concerning their digital records is received, the Provider preserves them unchanged to the extent required by applicable law. If the user does not choose how to dispose of the records, they are deleted within the period established by applicable law; for relationships governed by the Digital Code of the Kyrgyz Republic, after one calendar year following the year in which withdrawal from the Service was received.

If individual records must be retained after withdrawal from the Service, the Provider informs the user of the records concerned and the grounds for their continued retention.

15. Service availability and liability

Pole is in closed beta testing and is provided in its current condition.

The Pole team aims to provide stable operation of the Service but does not guarantee:

• continuous or error-free operation of the application;
• the absence of temporary outages;
• preservation of all test data;
• compatibility with every device and configuration;
• preservation of the current set of features;
• the absence of changes to the interface or application behavior.

The user independently decides whether to use the Pole beta version in light of its testing status.

The Pole team is not liable for the actions of other users or the administrations of user servers except where such liability is expressly provided by applicable law.

No provision of the Agreement excludes or limits the Provider's liability or the user's rights to the extent that such exclusion or limitation is prohibited by applicable law, including mandatory consumer rights relating to a digital service.

16. Complaints, disputes, and appeals

The Provider makes it possible to submit complaints through the website or application, including complaints concerning Service quality, infringement of intellectual or digital rights, violations of Service usage rules, unlawful dissemination of or restriction of access to digital records, and other alleged violations of law.

If a complaint concerns the actions of another user, the Provider informs the affected users about the complaint and provides data relating to it to the extent and in the manner permitted by law.

The Provider takes the measures necessary to remedy a confirmed violation within no more than five business days. If more time is required, within five business days the Provider informs the applicant of the reasons and a justified time frame. The applicant is informed of the measures taken by the same method used to submit the complaint unless another method was selected.

Disputes between users are considered under this Agreement, with each affected party given an opportunity to state its position. The Provider's decision may be appealed in accordance with applicable law, including any mandatory pre-trial procedure before a sector regulator where such a procedure is established by law.

17. Governing law and consumer protection

This Agreement is governed by the law of the Kyrgyz Republic unless otherwise required by mandatory provisions of applicable law.

If the user is a consumer and the mandatory rules of the country of the user's habitual residence grant additional rights, the choice of the law of the Kyrgyz Republic does not deprive the user of that mandatory protection.

18. Discontinuation of use

The user may stop using Pole at any time.

For questions about deleting the account and related data, the user may contact hello@pole.team.

Certain data may be temporarily retained after use of the Service ends where necessary for security, diagnosis of technical problems, compliance with mandatory legal requirements, or other purposes provided by the Privacy Policy.
